PEOPLE'S PETITION IN SUPPORT OF THE RESOLUTION MODIFICA DELLO STATUTO COMUNALE

I sottoscritti cittadini, premesso che:
  • la gestione del servizio idrico integrato in Italia è attualmente normata dal famigerato Art. 23bis della Lg. 133/2008 che prevedeva, in via ordinaria, il conferimento della gestione dei servizi pubblici locali a imprenditori o società mediante il ricorso a gara, facendo largo forzatamente all’ingresso di privati;
  • il recente Art. 15 del D.L. 135/2009 ¬ che ha modificato l’Art. 23bis ¬ muove passi ancor più decisi verso la privatizzazione dei servizi idrici e degli altri servizi pubblici, prevedendo l’affidamento della gestione dei servizi pubblici a rilevanza economica a favore of employers or companies in any form constituted identified through competitive procedures open to public, or alternatively a joint venture company with private capital, public and private not less than 40%, and the termination of credit facilities in-house companies, total controlled by the municipalities (existing at the date of August 22, 2008) on 31 December 2011;

ask the City Council approve the resolution for the amendment of the Statute submitted by Councillor Henry Perilli which proposes to integrate the Charter Hall with the introduction of the following article: definition of local public services without economic importance.

The City, having regard to Articles 1, 2, 3, 5, 43, 114, 118 of the Constitution, recognizes local public services such as water service, health service, public health, social services, public education, protection of cultural heritage and environmental resources and landscape and everything else will recognize the City Council of overriding public interest.

recognizes the human right to water, namely access to water as a human right universal, indivisible, inalienable and status of water as a public good.

Confirmation the principle that all waters, surface and groundwater, even if extracted from underground, shall be public and are a resource to be used according to criteria of solidarity and the principle that must be kept in public ownership of networks and management of integrated water services.

recognizes the integrated water service status of local public service free of economic and non-profit organization, whose management must be implemented according to the Articles. 31 and 114 of D. Decree n.267/2000, as a public service essential to ensure the universal right to water and human dignity of all citizens.
